Cal/OSHA Workplace Violence (SB 553) Compliance for Hospitality

8 CCR §3343 — California Senate Bill 553 — effective July 1, 2024. Requires nearly every California employer to establish a written Workplace Violence Prevention Plan, maintain a violent-incident log, and train employees annually.

Nearly all California employers with operations subject to Cal/OSHA jurisdiction. Limited exceptions for telework and small employers (<10 employees not accessible to the public).

How Cal/OSHA Workplace Violence (SB 553) Applies to Hospitality

Hospitality is a high-risk sector for SB 553 — guest interactions, intoxicated patrons, late-night operations, and isolated workers (housekeeping). Plan must address panic buttons in some jurisdictions and de-escalation training.

  • Written Workplace Violence Prevention Plan (WVPP) — separate document or integrated section of IIPP
  • Designated person(s) responsible for implementing the plan
  • Active employee involvement in plan development
  • Procedures to identify and evaluate workplace violence hazards
  • Procedures to correct violence hazards in a timely manner
  • Effective response to actual or potential violence emergencies
  • Communication system for reporting concerns and incidents without retaliation
  • Violent Incident Log — separate from OSHA 300, retained 5 years
  • Records retention: training (1 year), hazard assessments (5 years), incident investigations (5 years)
  • Annual training; additional training when new hazards arise
